Communities can still vouch for club sports facilities

In each individual case, it must be determined, whether the building project in question, such as a fitness club, is a commercial or club-confined project.
Particularly with regard to providing a guarantee for construction of a sports club centre, it will be continued to consider each individual case on its own merits, stated Reinhold Gall, regional state minister, Klaus Tappeser president of the sports association of the German region of Baden Württemberg, and Rainer Brechtken, president of the Swabian gymnastics association in a mutual statement. Basically, provision of a guarantee is possible and can be approved only for that part of a project which serves community purposes. Projects which cannot be supported are for example, commercial fitness clubs, physiotherapy practices or restaurants integrated into a community centre. "In this way, clarity is established for all parties concerning the legal position", emphasised the presidents Tappeser and Brechtken.
According to a report in a Stuttgarter newspaper (Stuttgarter Zeitung) dated May 3, 2012; the local operator of a commercial fitness studio in Kirchheim, Germany, had brought charges requesting that the local sport club, VfL Kirchheim to be removed from the register of associations as, after construction of planned club centre with fitness club, this club no longer fulfilled the purpose of community service.
